Welcome to KindMums! By accessing and using our website, courses, and resources, you agree to comply with and be bound by the following terms and conditions. These terms govern your use of our services and resources, including online courses, downloadable materials, and any other products or services offered by KindMums. If you do not agree to these terms, please refrain from using our services.

“Services” refers to all courses, resources, and products provided by KindMums.

“You” or “User” refers to the individual accessing or using our services.

To enroll in a course, you must complete the registration process and pay the required fees. Payment can be made via our accepted payment methods.

All fees are non-refundable except in cases of course cancellation by KindMums or other specific circumstances outlined below.

Upon successful registration and payment, you will receive access to the course materials for the duration specified.

All course content is for personal use only and may not be shared, copied, or distributed without explicit permission from KindMums.

KindMums reserves the right to update or modify course content at any time.

All content provided by KindMums, including but not limited to text, graphics, logos, images, and course materials, is the property of KindMums or its content suppliers and is protected by copyright and other intellectual property laws.

You may not use, reproduce, or distribute any content without prior written permission from KindMums.

Data Collection: KindMums collects and processes personal data in accordance with applicable data protection laws. By using our services, you consent to the collection and use of your data as outlined in our Privacy Policy.

Use of Data: Personal data collected is used for the purpose of providing and improving our services, processing transactions, and communicating with users.

Data Security: We implement appropriate technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction.

Confidentiality: All personal information shared with KindMums will be kept confidential and will not be disclosed to third parties without your consent, except as required by law.

Data Retention: Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

Provision of Personal Information: By supplying personal information, you are consenting to KindMums holding and using it for the purposes for which it was provided. Information provided will be kept for as long as necessary to fulfill that purpose.

Purposes of Information: Information is held for purposes including but not limited to: General administration requiring personal and course details. Assessment of applications for suitability for events. Management of training processes such as progress and competency reviews and teacher training certification. Alumni operations, including fundraising. Provision of advice and support to applicants via academic staff. Applicant services and internal research, including monitoring quality and performance.
Access to Information: Employees, contractors, and agents of KindMums may be given access to any personal information collected, but its use shall be limited to the performance of their duties. They are required to keep that information confidential.

Accuracy and Security: The accuracy of personal information provided by applicants may also be checked by KindMums against relevant external sources. We undertake to maintain data in secure conditions, and to process and disclose data only within the terms of our data protection notification.

Updating Information: The details above indicate the nature of this notification but are not exhaustive. KindMums is reliant on applicants for much of the data held; please help us keep records up to date by notifying us of any alterations to personal details.
Legal Requirements: Except to the extent that we are required to do so by law, in connection with any legal proceedings, or in order to establish, exercise, or defend our legal rights, we will not disclose your personal information to any other party without first obtaining your permission.

The content and services provided by KindMums are for informational purposes only and do not constitute medical, psychological, or professional advice. Mindfulness practices can complement but are not a substitute for professional therapy or medical treatment.

Users of the information provided by KindMums are responsible for their own mental and physical health.

KindMums is not responsible for any decisions made based on the information provided.

KindMums does not guarantee specific outcomes or results from the use of our services.

To the maximum extent permitted by law, KindMums is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services.

Limitation of Liability: KindMums’ liability for any claim arising out of or in connection with these terms and conditions shall be limited to the amount you paid for the services that gave rise to the claim. This limitation of liability applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive, or consequential damages, loss of use, loss of data, loss of income or profit, loss of or damage to property, and claims of third parties.

Any representations made to KindMums about the user will be treated as true and correct. KindMums is not required to verify the veracity of such representations. Users are responsible for providing accurate information, particularly concerning their mental health status when enrolling in courses.

(a) You agree to use our services for lawful purposes only and to respect the intellectual property rights of KindMums and other users. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

KindMums reserves the right to terminate your access to our services at any time, without notice, for any violation of these terms or for any other reason deemed necessary.

These terms and conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

KindMums reserves the right to update or modify these terms and conditions at any time. Any changes will be posted on our website, and continued use of our services constitutes acceptance of the revised terms.

Data Protection Policy

This policy provides a framework for ensuring that KindMums meets its obligations under the General Data Protection Regulation (GDPR) and associated legislation (‘data privacy legislation’). It applies to all processing of personal data carried out for a KindMums purpose, irrespective of whether the data is processed on KindMums equipment or by third parties.

‘Personal data’ means any information relating to an identifiable living individual who can be identified from that data or from that data and other data. ‘Processing’ means anything that is done with personal data, including collection, storage, use, disclosure, and deletion.

More stringent conditions apply to the processing of special category personal data. ‘Special category’ means personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying an individual, data concerning health, or data concerning an individual’s sex life or sexual orientation.

The processing of personal data must comply with data privacy legislation and, in particular, the six data privacy principles. In summary, they require that personal data is:

Processed fairly, lawfully, and in a transparent manner;
Used only for limited, specified stated purposes and not used or disclosed in any way incompatible with those purposes;
Adequate, relevant, and limited to what is necessary;
Accurate and, where necessary, up-to-date;
Not kept for longer than necessary;
and Kept safe and secure.

In addition, a new accountability principle requires us to be able to evidence compliance with these principles.

KindMums handles a large amount of personal data and takes seriously its responsibilities under data privacy legislation. It recognizes that the mishandling of an individual’s personal data may cause them distress or put them at risk of identity fraud. As a result, it is committed to:

Complying fully with data privacy legislation;
Where practicable, adhering to good practice, as issued by the ICO or other appropriate bodies;
and Handling an individual’s personal data in a careful and considerate manner that recognizes the importance of such information to their privacy and welfare.

 

KindMums seeks to achieve these aims by:

Ensuring that staff, students, and other individuals who process data for KindMums purposes are made aware of their individual responsibilities under data privacy legislation and how these apply to their areas of work. For example, employment contracts include a clause drawing the attention of the employee to data privacy legislation and KindMums’ data protection policy;
Providing suitable training, guidance, and advice.

Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

Appropriate technical and organizational measures shall be taken against unauthorized or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data. Data held is kept with appropriate levels of security, for example, electronic data may be either encrypted or password protected as appropriate. Access to personal data will be kept to the minimum number of users. Users will follow the guidance in usage of data and be made aware of this through the training process or through work contracts.

The GDPR provides individuals with rights in connection with personal data held about them. It provides individuals with the right to access data concerning themselves. KindMums will provide individuals with this information if requested.

KindMums will investigate incidents involving a possible breach of data privacy legislation in order to ensure that, where necessary, appropriate action is taken to mitigate the consequences and prevent a repetition of similar incidents in the future. Depending on the nature and severity of the incident, it may also be necessary to notify the individuals affected and/or the ICO. A breach will occur where, for example, personal data is disclosed or made available to unauthorized persons or personal data is used in a way that the individual does not expect. Incidents involving failures of IT systems or processes must be reported to the KindMums CEO immediately upon discovery. KindMums will liaise, as appropriate, with the Information Compliance Regulator.

KindMums regards any breach of data privacy legislation, this policy, or any other policy and/or training as a serious matter, which may result in disciplinary action or (in the case of a self-employed contractor) termination of engagement. Depending on the nature of the breach, an individual may also find that they are personally liable (for example, it can be a criminal offense for a member of KindMums to disclose personal information unlawfully).

Your consent is requested. KindMums needs your agreement to hold your data provided on this application so we can provide you with the services you require from us, ensure we know how you prefer to be contacted, and keep a record of your relationship with KindMums. By engaging with KindMums, you understand that:

You can ask to see your records to check their accuracy at any time.
You can ask for a copy of the personal data held about you at any time, and this request is free of charge.
You can request that data that is no longer required be removed from your file and destroyed.
